Description
Indian man Jimmie D. Oyler Sr. claims that the state has no rights over his property because of a Treaty from 1831. This dispute was over a man selling tax-free cigarettes. A Johnson County judge named Earle Jones denied a motion to dismiss the case. Oyler Sr. and his lawyer, Pamela Thompson say the state has no jurisdiction over Oyler's property near De Soto, which has been owned by his family for generations. Assistant District Attorney Melinda Whiteman states that Indians and Indian lands are subjected to state law.
